1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

If you are using the App on behalf of a minor (under 13 or the applicable age in your jurisdiction), you represent that you are the parent or legal guardian and accept these Terms on their behalf.

2. Description of Service

BrushMint is a dental hygiene habit tracking application that provides:

• A guided brushing timer with dental zone mapping
• Habit tracking with streaks, health scores, and statistics
• Multiple family profiles with individual tracking
• Themed visual and audio experiences
• Gamification with coins, achievements, and rewards
• Optional Premium subscription with enhanced features
• Optional iCloud backup for data synchronization

BrushMint is a wellness tool and does not provide medical advice. Always consult a dental professional for dental health concerns.

3. Account and Profiles

The App does not require account registration. Profiles are created locally on your device. You are responsible for:

• The accuracy of information entered into profiles.
• Maintaining the security of your device and profile data.
• All activity that occurs under profiles on your device.
• Supervising the use of the App by minors under your care.

4. Subscriptions and Purchases

4.1 Free Tier

The App is free to download and use with basic features. The free tier includes advertisements.

4.2 Premium Subscription

• Premium features are available via auto-renewing subscriptions (monthly or annual plans).
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel subscriptions through your device's App Store or Google Play Store settings.

4.3 Free Trial

We may offer a free trial period. If you do not cancel before the trial ends, you will be automatically charged for the subscription.

4.4 Refunds

Refunds are handled by Apple (App Store) or Google (Play Store) according to their respective refund policies. We do not process refunds directly.

5. In-App Currency

The App features virtual coins that can be earned through brushing sessions and watching rewarded advertisements. These coins:

• Have no real-world monetary value.
• Cannot be exchanged for cash or transferred between users.
• May be used to unlock in-app content such as themes and sounds.
• May be modified, reset, or discontinued at our discretion.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Modify, adapt, or create derivative works based on the App.
• Remove, alter, or obscure any proprietary notices in the App.
• Use automated systems or bots to interact with the App.
• Interfere with or disrupt the integrity or performance of the App.
• Attempt to gain unauthorized access to the App's systems or networks.

7. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, audio clips, video clips, themes, and software — are the exclusive property of BrushMint and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• That the App will be uninterrupted, error-free, or secure.
• That results obtained from the App will be accurate or reliable.

BrushMint does not guarantee any specific health outcomes from using the App. The App is a habit-tracking tool, not a medical device.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BrushMint and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or in connection with your use of the App.

Our total liability for any claims arising from your use of the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless BrushMint and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by updating this page. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved through binding arbitration or in the competent courts of the jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
